01. INTRODUCTION

In doing business with Billoomi Fashion Private Limited through online or offline mediums you are deemed to have read and agreed to the these terms and conditions which govern the relationship between you (hereinafter referred as the client / customer / buyer / label owner / consumer) and Billoomi Fashion Private Limited (hereinafter referred as the company / manufacturer / exporter / service provider / supplier), a company incorporated under Companies Act, 1956 under Ministry of Corporate Affairs, Government of India. These Terms and Conditions apply in full force and effect to your use of this website and the services of its company, you expressly accept all terms and conditions contained herein in full. You must not use this website or use the company services, if you have any objection to any of these Terms And Conditions.

This website and its company services is not for use by any minors (defined as those who are not at least 18 years of age), and you must not use this website or its company services if you a minor. These terms and conditions are revised on a periodic level as per the rules of origin country, international trade policy, shipping policy and business environment. This can be amended / revised / updated without any prior notice.

02. PRIVACY STATEMENT

We are committed to protecting your privacy. Authorized employees within the company are the only people allowed to use information collected from visitors, and only on a need to know basis. We constantly review our systems and data to ensure the best possible service for our customers. However, we are legally bound to reveal information, including personal information, if law enforces it.

03. CONFIDENTIALITY

Client records are regarded as confidential and therefore will not be divulged to any third party, other than our shipping company and supplier(s), and if legally required to do so, to the appropriate authorities. Clients have the right to request copies of any and all their personal records we keep, on the provision that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Your trust is important to us, and we will not do anything to violate that trust.

You are solely responsible for your designs (content / style / model / print / pattern / artwork / trims) and the consequences of manufacturing them, posting or publishing them. In connection with each of your submissions, you affirm, represent, and/or warrant that: (I) you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all such submissions to enable inclusion and use of such submissions in the manner contemplated by us and these Terms and Conditions; and (II) you have the written consent, release, and/or permission of each and every identifiable individual person in such submissions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of such submissions in the manner contemplated by us and these Terms and Conditions. In furtherance of the foregoing, you agree that you will not: (I) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant us all of the rights granted herein; (II) publish falsehoods or misrepresentations that could damage us or any third party; (III) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; or (IV) post advertisements or solicitations of business. We reserve the right to refuse manufacturing or working on your given design / project in case if find it a voilation of any copyright issue without prior notice. You understand that when you submit your design or work details in any form to BILLOOMI FASHION we may authorize such content / design details to be distributed or syndicated to or published on other BILLOOMI FASHION environments.

04. RESTRICTIONS

You and the company both are expressly and emphatically restricted from all of the following:

1. Publishing any website material or our services in any media - print, electronic, social etc.

2. Selling, sublicensing and/or otherwise commercializing any website material or our services.

3. Disclosing our rate / cost of services (manufacturing or related) to any other party.

4. Putting any review or comment or referring our mutual communication in any media which may be damaging to our company reputation.

5. Using our services in any way that impacts other user / customer availing our services.

6. Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to our company.

In violation of above restrictions, the company reserves the right to file the case of defamation and claim the compensation against the loss of reputation and goodwill.

05. COMMUNICATION POLICY

We validate all communication in writing and through email. However for general discussion may take place through whatsapp, skype and phone call as well.

Email Policy: We attempt to respond in 48 hours or less through email due to time zone difference. The nature of email will also affects the response time. The official and authorized email IDs are: billoomi.fashion@gmail.com and info@billoomifashion.com

Whatsapp: Once you become our client, we bring you on our whatsapp communication mode for quick contact pertaining to your order status, queries and general communication with intention to offer you legendary customer support. Skype: In 24 hours of advance notice you can fix Skype meeting with us. In general our Skype meeting time is IST 11:00 pm. Billoomi Fashion keeps you updated on your order through your give email and/or whatsapp. In an event when you stop responding due to any reason, Billoomi Fashion sends you reminders. Billoomi Fashion sends you three reminders and after not getting any response to the third reminder, Billoomi Fashion stops working on your project / order and forfeits the amount you have paid for the given order / assignment / project.

06. WAVIERS AND FREEBIES

(a) Your sampling fee will be waived off at the time of production order provided you place production order in same style with minimum 200 pcs per style (mix sizes).

(b) If your quantity is less than 300 pcs (including all styles), we will not offer you free custom label and tag for the given order. It may cost you USD 300 additional.

07. SHIPPING CHARGES / FREIGHT

DHL and UPS are our primary carriers. In addition to that, we might also use different courier services which seem best for the location of delivery. The rate charged for the shipping of your order is based on the weight of your products, and your location. Hence the best rates (shipment weight 30 KG or above) can be given only once the consignment is ready.

Shipping charges and subsequent custom clearance, documentation and taxes to be paid in advance. Billoomi Fashion does not send goods on the basis of "Destination Duty Paid". Hence any duty and/or tax arises due to your local laws, the company is not responsible for that and the same is supposed to be paid by the customer.

08. CANCELLATION OF AN ORDER

You have the right to cancel an order within 24 business hours once the payment is made. Please however bear in mind that 'Billoomi Fashion Pvt Ltd' produces custom manufactured products based upon your order. If the garment that you have ordered has past the 1 day period and has been sent for the production process then a cancellation charge of 50% of the order value may apply.

If you would like to cancel an order, please contact us in writing email billoomi.fashion@gmail.com with all the product details (if only few styles to be cancelled from an order), invoice number, date and cancellation instructions. We will revert to you in 48 business hours about the state of your order, and whether any cancellation charges will apply or not.

Billoomi Fashion does not entertain any order cancelation due to the reason that your chosen "stock printed fabric" is sold out or is not available in desired quantity. In case of production order using stock printed fabric, we do not take the responsibility about the availability of same print fabric what you got at the time of sampling unless you have paid us to reserve the stock of fabric. However, if such situation arises we can provide you several similar options and you should be flexible enough to choose from.

Please note an order cannot be cancelled once the ordered goods have been delivered to you or are in transit to you from 'Billoomi Fashion Pvt Ltd'. This is on account of the fact that all our goods are produced to your custom design, measurements or specifications.

If customer fails to reply or approve any sample e-mailed / sent to him / her within 3 reminders or/and 15 days, their order will automatically be canceled and amount paid to us will be forfeited.

09. DELAYS IN DELIVERY

It is your responsibility to ensure all contact details including the delivery address are correct and that either you or a person nominated by you is available in person to accept and sign for the delivery of the goods when they are delivered to your address.

'Billoomi Fashion' takes no responsibility for goods that fail to be delivered or fail to be signed for, on account of incorrect delivery address supplied by you at the time of placing your order. We are also not responsible for failure of delivery if the address provided by you is found closed or inaccessible, by the postal service or courier agency, at the time of delivery.

'Billoomi Fashion' will choose established postal service or courier companies to ship your orders through. Once however the goods have been dispatched, we take no further responsibility for any late or lost deliveries.

10. COMMENCEMENT OF AN ORDER AND TURNAROUND TIME

Standard for Sampling - 2 to 3 weeks

Standard for Production - 8 to 12 weeks

Lead time may affect due to style detailing, total quantity, time taken in decision making by client, and anything which is beyond the control at factory level. Please note that the turnaround time commences from the day we receive the fund in our bank account. We start working on your order by forwarding your order details to our backend team (sampling and production). Hence no changes can be made in it once it has been forwarded to the production department.

Your order details are required to be in standard format such as tech pack with clear detailing about your style / design, fabric, color (Pantone Color Code), measurement and quantity. If your given details are not in standard format, we may contact you back and ask for missing details or ask to clarify on given details if that is misleading or confusing.

In event of incomplete order details, lead time may be extended. Lead time also get affected if you’re not taking too much time on approvals or in decision making or and anything which is beyond the control at factory level.

The Production of your custom made apparel, completely depends upon the communication that is kept with us. Our production time stops when we wait for approval from customer and this increases the production time that we give to our customers.

Further, due to fabric unavailability or unexpected time taken to get desired result in printing / embroidery / sequins and beaded works, denim washing and other issues, production can be delayed. The standard lead time / turnaround time is effective only if your given details are complete, correct file format is given and you provide your approvals on time. Usually orders do not take that long to be completed, however we will be in continuous communication with you throughout the process of production and inform you about the delays time to time.

11. RETURN AND REFUND POLICY

Billoomi Fashion Pvt Ltd provides its customers with only strictly quality-controlled goods without exemption according to your quality standard. We will follow the specifications as instructed by the customer at the time of order. Any changes during the production will be notified and confirmed / approved by the customer.

In general we DO NOT ACCEPT any returns or refunds for any customized goods at all once they have been shipped after taking all the approvals throughout the process. So you can ask for pictures, video or you (or your representative) can visit our site to check the orders quality if you feel it is needed.

In some of the exceptional and following conditions only we entertain any return / refund request :

1. The product you have received is significantly different from the sample you have approved or description you provided.

2. The product you have received is not what you asked for and the problem which you have found can’t easily be fixed.

3. It is beyond tolerance level -

Neck and armhole : +/- .5 to 1 cm

Chest : +/- 1 to 1.5 cm

Length : +/- 1 to 2 cm

All repair / replace / refund request should be duly submitted to Billoomi Fashion Pvt Ltd within 7 days of shipment you receive through email describing the valid reason along with evidence attached to the email.

Once you send the email informing about the problem, Billoomi Fashion reviews the details provided by you vis-a-vis our internal record of the production. Based on the details provided by you the company takes the decision about possible options of - (i) free repair, (ii) replacement, (iii) discount on any of running order or on upcoming order or (iii) refund.

Billoomi Fashion reserves the right to take the shipment (entire or partial goods) back to its warehouse before any replacement, discount or refund is issued to you.

If it is a case of refunds, it should be the same amount you have already paid, provided in the same form (mode of payment) as your original payment.

In no event Billoomi Fashion refunds you the shipping charges, banking transaction charges and any duty or taxes incur on the affected shipment.

Billoomi Fashion reserves the right to choose whether the company will issue you a full refund or partial refund considering the problem with the order. Refund will always be considered after taking the goods back from you to the Billoomi Fashion's warehouse and only after physical examination of the fault claimed by you (the buyer). If the goods are under repairable condition then Billoomi will repair the goods and will send back to you (the buyer) instead of refund. In case repair / correction is not possible then only refund can be considered.

12. PAYMENT POLICY AND TRANSACTION FEES

All payments can be accepted through Bank to Bank (Wire Transfer) only.

There will be a transaction charge (surcharge) applied (minimum USD 18 to maximum USD 35) over and above the total invoice value.

13. LIMITATION OF LIABILITY

In no event shall Billoomi Fashion Pvt Ltd, nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of our services, whether such liability is under contract, tort or otherwise, and Billoomi Fashion Pvt Ltd, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of our services.

14. VALIDATION OF TERMS AND CONDITIONS

Billoomi Fashion Pvt Ltd is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Website.

15. GOVERNING LAWS AND JURISDICTION

These Terms will be governed by and construed in accordance with the laws of India, and you submit to the non-exclusive jurisdiction of New Delhi (India) for the resolution of any disputes.
